2013 CARB Deadlines

While the California Construction Trucking Association is in federal court seeking to strike down the Truck and Bus Regulation, CCTA members and all other owners of heavy-duty diesel trucks must deal with compliance issues. Nearly all diesel-fueled trucks with a gross vehicle weight rating greater than 14,000 pounds operated in California are subject toCARB’s Truck and Bus Regulation

The rule took effect this year affecting truck model years 1996-1999 for trucks greater than 26,000 pounds, with requirements for exhaust retrofit particulate filters or replacing vehicles with newer vehicles originally equipped with PM filters. 

The regulation requires accelerated replacements for both lighter (less than 26,000 pounds) and heavier vehicles that do not have PM filters installed starting January 1, 2015.  Between 2015 and 2023 trucks that do not achieve 2010 model year engine emission levels will need to be replaced with those that do. 

Vehicle owners should take note of impending deadlines in order to place equipment orders and prepare for compliance with a variety of regulations. Deadlines coming up quickly for diesel vehicles include: January 1, 2013

Under the Truck and Bus regulation, diesel truck fleets must either install diesel particulate filters (or upgrade equipment) on trucks with 2000 to 2004 model year engines or meet phase-in option requirements.

Transport Refrigeration Units with 2005 model year engines must be replaced with Ultra-Low-Emission TRUs.

For vehicles covered under the Drayage Truck Regulation, 2005-2006 engine model year trucks greater than 33,000 lbs. gross vehicle weight rating must have diesel soot filters.

Tractor-Trailer Greenhouse Gas regulation (>53-ft box truck units):

  • Fleets with 20 or fewer affected trailers must register if they want to use a compliance option that will allow them up to four additional years to participate in the Small Fleet Compliance Plan.
  • Low-rolling resistance tires are required for 2010 model year and older tractors that pull 53 foot-long box-type trailers.
  • SmartWay aerodynamic requirements must be met by all 53-foot or longer box-type trailers not using a phase-in option.

In-Use Off-Road Diesel Vehicle Regulation

CARB is currently enforcing some provisions of the off-road regulation and waiting for approval of their request for a waiver from the Clean Air Act from US EPA for the authority to enforce the rest, including:

All fleets are required to:

  • Limit equipment idling to less than five minutes, except under certain situations.  Medium (2,501 to 5,000 total fleet hp) and large fleets (more than 5,000 total fleet hp) are required to have a written idling policy.
  • Have registered their equipment with ARB and labeled their equipment with ARB issued equipment identification numbers (EINs).
  • Notify buyers that equipment sold could be subject to the regulation.
  • Report equipment bought or sold within 30 days of the purchase/sale.

Upcoming Compliance Dates For Provisions In Effect

EINs and Labeling: Beginning January 1, 2013 all vehicles subject to the off-road regulation must be labeled on both sides of the equipment with the unique EIN issued by CARB. The new labeling requirement was included in amendments to the regulation that became effective in December 2011. By March 1, 2013 Large fleets (>5,000 combined hp) are required to:

  • Submit an affirmation that company and fleet information submitted to CARB is correct and the fleet complies with the regulation with an Annual Report and Responsible Official Affirmation of Reporting (ROAR) form.
  • Report any changes to the fleet since the January 1, 2012.
  • Report engine hours for equipment a fleet may want to classify as year-to-year low use on or before January 1, 2013. Classification of equipment as year-to-year low use could substantially reduce a fleet’s compliance obligations. We encourage all fleets to routinely record engine hours for all equipment.

Provisions that Will Take Effect Once EPA Approves the Regulation

Once CARB receives US EPA authorization, which some believe could occur as soon as late November or December 2012, the following prohibitions will take immediate effect.

  • All fleets will be prohibited from adding any Tier 0 engines.
  • Until January 1, 2013 fleets can only add equipment with a Tier 1 engine if the equipment had an EIN as of January 1, 2012.
  • Starting January 1, 2013 all equipment added to large and medium sized fleets must be Tier 2 or higher tier.
  • The fleet performance requirements begin for large fleets on January 1, 2014, medium sized fleets on January 1, 2017 and small fleets (2,500 total hp or less) on January 1, 2019.  By these and subsequent compliance deadlines, a fleet must demonstrate that it has either met the fleet average target for that year or has completed the Best Available Control Technology (BACT) requirements.

Portable Engine Air Toxic Control Measure

CARB portable engine Air Toxic Control Measure (ATCM) applies to diesel fueled portable engines 50 horsepower and greater.  The portable engine ATCM is separate from the Portable Equipment Registration Program (PERP), which is voluntary.

Portable engine ATCM establishes a weighted particulate matter (PM) emission fleet average standard expressed as grams per brake horse power-hour (g/bhp-hr) for three horsepower ranges.

January 1, 2013 is the first fleet standard compliance date, and fleets must meet the following weighted PM emission fleet averages; 0.3 (g/bhp-hr) for engines less than 175 hp, 0.15 (g/bhp-hr) for engines 175 to 750 hp, and 0.25 (g/bhp-hr) for those greater than 750 hp. 

Submit by March 1, 2013 a signed statement of compliance confirming that fleet standards have been achieved and a summary identifying each portable engine in the fleet and the associated emission rate (g/bhp-hr).

Portable engines included in the fleet are those that are part of the fleet at the time the fleet standard became effective. 

The engine identification shall include, at a minimum, the make, model, serial number, and year of manufacture for each engine. 

In addition:

  • Subsequent fleet standard compliance dates are January 1, 2017 and January 1, 2020.
  • Prohibition of Tiers 0, 1 and 2 engines exists.
  • Portable engine ATCM also includes recordkeeping and reporting requirements.

CCTA is available to answer your questions about the off-road regulation, portable engine ATCM and Truck and Bus Regulation.  Working with the CIAQC, CCTA continues to insist to CARB that the diesel regulations must be practical, cost-effective and technologically feasible.  Past amendments to the regulations spearheaded by CCTA and CIAQC have provided fleet owners some increased flexibility and temporary relief, but the requirements in place still present a significant burden for contractors.  Less costly alternatives to these and other air quality regulations remain a top priority for the association.
